Dignity For All Schools Act is Passed by NY City Council, Overriding Mayor Bloomberg's Veto
Parents in New York City fight to stop the harassment and bullying of their children for illegal reasons such as wearing glasses, too fat, too thin, gay, tall, short, dark-skinned, light-skinned...it must stop. The new law will perhaps not stop all the discrimination, but may force officials who ignore what is going on to be more active in preventing it. On Thursday, September 9, 2004, the City Council overrode Mayor Michael Bloomberg's veto of the Dignity for All Schools Act (Intro 188-A), a bill that will require that the Department of Education establish clear guidelines that prohibit harassment and bullying in schools.
The mayor said he supports the goal of the legislation, but vetoed it because he said the task of disciplining students should rest with educators. The council needs 35 votes to override the mayor's veto; the council voted 44 to 3 to override. Republican Councilmembers James Oddo, Andrew Lanza, and Dennis Gallagher sided with the mayor. "We are sending a back-to-school present to all of our students and all of our teachers - namely that bullying has no place in our schools," said Councilmember Alan Gerson, who drafted the bill. The next Stated Meeting is scheduled for September 28, 2004. POLS PASS SCHOOL BULLY BILL David Seifman, NY POST, September 10, 2004 September 10, 2004 -- Public schools are going to have to compile figures on bullying and harassment under a law that the City Council passed yesterday over Mayor Bloomberg's objections. In a 44-3 vote, the council easily overrode the mayor's earlier veto of the Dignity in All Schools Act. The only dissenters were the three Republicans. Council Speaker Gifford Miller said he had tried "literally for years" to reach a compromise with school officials who were adamant about not collecting the statistics. "It seems to me the Department of Education is seeking to stick its head in the sand," Miller said. "When you stick your head in the sands, you know what's exposed." The new law includes protection from retaliation for those who accuse other students and staff of harassment. When the bullying bill was introduced in April, school officials said it was too broad and might make the city liable for bullying incidents on subways, ferries or other public places where students congregate. Council puts a hurt on bullies BY FRANK LOMBARDI DAILY NEWS CITY HALL BUREAU Friday, September 10th, 2004 The City Council struck back at bullies yesterday, passing a law that requires city schools to crack down on the punks over Mayor Bloomberg's veto. Backers hailed the measure as a "back-to-school present" for thousands of students who are subjected to taunts, threats and intimidation from fellow pupils. The new law, approved 43-to-3, requires the Department of Education to establish a formal policy that bans bullying and other acts of harassment. The law leaves the specifics, such as punishments, to the schools chancellor. The Dignity in All Schools Act also requires principals to report all bullying - including incidents on school buses and public transportation - to designated regional superintendents. The law requires the department to issue a public report on school bullying by July 30 of each year. "Every student should be able to attend a school without fear of being bullied, harassed or attacked," Council Speaker Gifford Miller (D-Manhattan) said. Bloomberg and school officials argued that school bullying is already prohibited by state law, as well as by a discipline code and student bill of rights established by the schools chancellor. In vetoing the measure, Bloomberg argued that "policy on student harassment is beyond the jurisdiction of the City Council." Proposed Int. No. 188-A Proposed Int. Legislative findings: The Council finds that many students, teachers, administrators and others in the New York city school communities are plagued by harassing behavior that interferes with students' educational performance, opportunities and emotional or physical well-being and the well-being of the entire school community. Accordingly, the Council finds that it is necessary to establish strong policies in our City's schools prohibiting harassment for any reason including reasons based, in whole or in part, upon, but not limited to, a person's actual or perceived race, color, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender, sex, family composition or circumstance, economic circumstance, physical characteristic, medical condition or school performance. § 2. Chapter 1 of title 10 of the administrative code of the city of New York is hereby amended by adding a new section 137 to read as follows: §10-137. Prevention of harassment on school premises. a. Definitions. For the purposes of this section, the following terms shall have the following meanings: 1. "Department" shall mean the New York city department of education. 2. "Gender" shall mean actual or perceived sex and shall also include a person's gender identity, self-image, appearance, behavior or expression, whether or not that gender identity, self-image, appearance, behavior or expression is different from that traditionally associated with the legal sex assigned to that person at birth. 3. "Harassment" shall mean the creation of a hostile environment by, in whole or in part, conduct or verbal threats, taunting, intimidation or abuse, including conduct, verbal threats, intimidation or abuse for any reason, including, but not limited to, a person's actual or perceived race, color, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender, sex, family composition or circumstance, economic circumstance, physical characteristic, medical condition, school performance or any other characteristic or reason that has or would reasonably have the effect of substantially interfering with a student's educational performance, opportunities or benefits, or a student's mental, emotional or physical well-being, or that reasonably causes or would reasonably be expected to cause a student or other person to fear for his or her physical safety. 4. "Retaliatory action" shall mean, but not be limited to, dismissal, demotion, suspension, disciplinary action, negative performance evaluation, any action resulting in loss of staff, compensation or other benefit, failure to hire, failure to appoint, failure to promote, or transfer or assignment or failure to transfer or assign against the wishes of the affected person. 5. "School" shall mean each school within the New York city public school system that provides educational instruction to students at or below the twelfth grade level. 6. "School function" shall mean a school-sponsored extra-curricular event or activity or any event that takes place on school premises. 7. "School premises" shall mean the buildings, grounds or facilities, or any portion thereof, owned, occupied by, or under the custody or control of the department or of a school, used for the primary purpose of providing educational instruction to students at or below the twelfth grade level, and any vehicles owned, operated or leased by or on behalf of such institutions that are used to transport such students or the personnel of such institutions. School premises shall also include public transportation, such as subways, buses and ferries, when students use such public transportation to attend school or a school function. b. Prohibition of harassment. No person shall subject another person to harassment on school premises or at a school function. c. Policies and guidelines. 1. The chancellor of the city public school system shall create policies and guidelines, in accordance with the procedures set forth in subdivision three of section 2801 of the New York state education law, designed to create an environment for each school that is free from harassment. Such policies and guidelines shall include, but not be limited to, penalties or disciplinary measures for those found to have violated such policies and guidelines, and shall indicate when incidents of harassment must be reported to law enforcement authorities. Such policies and guidelines shall also specify that harassment is a basis for granting to a student who has been harassed a transfer to another school, commonly called a "safety transfer," and that harassment is a basis for disciplining any student who engages or has engaged in the harassment of others. 2. Such policies and guidelines required by paragraph 1 of this subdivision shall also: (i) include guidelines to be used in employee training programs, which training shall be given on a regular basis to all pedagogical staff and school safety officers to discourage the development of harassment by (a) raising the awareness and sensitivity of school employees to potential harassment, and (b) enabling employees to prevent and respond to harassment; (ii) include guidelines to be used in presentations given to students about conduct and harassment issues; such guidelines shall be designed to discourage the development of harassment by (a) raising the awareness and sensitivity of pupils regarding potential harassment, and (b) fostering empathy and empathetic conduct among students; (iii) be included in the code of conduct which the chancellor is required to disseminate pursuant to subdivision four of section 2801 of the New York state education law; (iv) be included in mail to parents or guardians of students at each school at the beginning of each school year, be posted in prominent places within each school and be translated and made available in the ten most common languages spoken in New York city and in any other language spoken by more than ten percent of the parents or guardians of children attending any individual school; and (v) be distributed to all staff, school safety officers and members of school safety committees. 3. The chancellor of the city public school system shall appoint the principal of each school as the person responsible for ensuring the dissemination of the anti-harassment policies and guidelines to all staff of each school, all school safety officers, all members of the school safety committee, and to all students and their parents or guardians, and for providing training to pedagogical staff and school safety officers. Such principal shall also ensure that the name and contact information of a school employee who can provide copies of such policies and guidelines is made available to all students, parents, guardians, staff and to the school safety committee. Such principal may designate a subordinate to assume the responsibilities required by this paragraph. d. Reporting. 1. The chancellor of the city public school system shall appoint the principal of each school as the enforcement officer responsible for ensuring the enforcement of the anti-harassment policies and guidelines established pursuant to subdivision c of this section and to whom reports of incidents of harassment on school premises or at a school function may be made. Each such principal may designate a subordinate to assume these responsibilities. The chancellor shall also appoint the superintendent of each region and/or district within his or her jurisdiction, or the designee of such superintendent, as the person to whom reports of incidents of harassment on school premises or at a school function may be made when such report concerns the principal or other person appointed or designated as the enforcement officer of a school. 2. The chancellor shall create procedures under which incidents of harassment on school premises or at school functions are tracked centrally for record keeping purposes, and procedures under which such incidents of harassment are reported promptly to the principal or his or her designee, or the superintendent of each region and/or district or his or her designee, who must complete, for each such incident, an incident report indicating information about the incident, including, but not limited to, the parties, the location where such incident took place, the date and time such incident occurred and type of harassment involved. 3. By no later than July 30 of each year, the department shall publish a statistical summary of all incidents of harassment that occurred on school premises or at a school function during the preceding school year. Such summary report shall indicate, at a minimum, the number and nature of incidents of harassment broken down by school, school district, region, borough and grade level, and shall be published on the department's website and by such other means as, in the chancellor's discretion, are reasonably determined to best disseminate such information to the public. 4. The department shall also include, on each school's annual report card or any similar document that the department creates, summary information about incidents of harassment at such school, which information shall include (i) a comparison of all incidents of harassment at such school with all incidents of harassment in all similar schools, as determined by the department and (ii) the number of safety transfers that were granted from such school to another school during the preceding school year. e. Protection of people who report incidents of harassment. Any person subjected to harassment or having reasonable cause to suspect that another person has been subjected to harassment on school premises or at a school function, who reasonably and in good faith either reports such information to appropriate school officials or to law enforcement authorities, or who initiates, testifies, participates or assists in any formal or informal proceedings pursuant to this section, shall not be liable for civil damages that may arise from the making of such report or from initiating, testifying, participating or assisting in such formal or informal proceedings, and no school official or employee shall take, request or cause a retaliatory action against any such person who either makes such a report or initiates, testifies, participates or assists in such formal or informal proceeding. §3. If any subsection, sentence, clause, phrase or other portion of this local law is, for any reason, declared unconstitutional or invalid, in whole or in part, by any court of competent jurisdiction, such portion shall be deemed severable and such unconstitutionality or invalidity shall not affect the validity of the remaining portions of the local law that added this section, which remaining portions shall remain in full force and effect. §4. Effective date. This local law shall take effect one hundred and eighty days after its enactment. GRS/MHG LS # 0188 4/21/04 Why is it so important to stop bullying at school? The following report comes from Wales: Call for 'Laura's Law' on bullying Robin Turner, The Western Mail, Sep 25 2004 LINK THE harrowing death of Welsh schoolgirl Laura Rhodes could lead to a "Laura's law" forcing schools to end bullying, according to a children's campaign group. Action on Rights for Children says Laura's death will be highlighted in Parliament next month when amendments to the Children Bill will be debated. Action on Rights for Children director Terri Dowty said, "The sad story of Laura's death will be used as an example of how our children are dying because of bullies ... it could become Laura's law. "It would mean her death could prevent hundreds of others in the coming years if schools which do not tackle bullying are treated in law as failing schools." Labour MP Hilton Dawson wants a duty on schools to prevent bullying to be enshrined in law in the new act, rather than being a regulation. Neath and Port Talbot County Borough Council said it would be "inappropriate" to comment at this stage. Laura's private hell at the hands of taunting bullies at Neath's Cefn Saeson Comprehensive School became public this week when her parents released a diary-style letter she wrote before taking a suspected overdose. The teenager's words were released after her emotion-packed funeral at Margam Crematorium on Wednesday. Yesterday, Wales Children's Commissioner Peter Clarke added that he wanted the National Assembly to ensure schools did more to overcome classroom bullies. He said, "It is time the Assembly got forceful on this issue and made it one of the highest priorities that schools have." The Swansea-based Children's Commissioner said some schools were not doing enough to help children like Laura. He said, "I cannot comment on her case specifically because there is still a police investigating going on and there will be an inquest. "But while some schools are doing fantastic things others are not taking the issue as seriously as they should. "There are mentoring schemes and other projects in some schools specifically aimed at reducing bullying but the challenge for Wales is to ensure this happens in every school. "In almost every conversation I have with children the subject of bullying comes up, so quite clearly all our schools must have this as one of their highest priorities." Research by Action on Children's Rights says 16 children a year in the UK kill themselves every year due to bullying. And the group says two million visits a year are made to GPs because of emotional problems, and 19,000 children in Britain attempt suicide every year - one every half hour. The "day in a life" essay released by Laura's parents Mike and Yvonne, of Cimla, Neath, ended with their daughter describing how she tried to cut her wrists after a typical day at school where she was taunted about her weight. She died after a suspected suicide pact with Rebecca Ling, 14, of Birmingham, a friend she met on the internet. Rebecca survived and is still in hospital in Birmingham. There have been a number of high-profile deaths involving bullied children in the past two years. These have included: An inquest in Swansea last year heard how 13-year-old Kirsty Botto of Landore hanged herself after being bullied in the community; Laura Killibard, 13, was founding hanged in her bedroom at her family home in Lisvane, Cardiff in 2002. An inquest heard police found no evidence of bullying, but after the hearing her parents George and Penny Killibard said their daughter's friends claimed she had been targeted. Last January an inquest heard 16-year-old Karl Peart of Northumberland died of a painkiller overdose. He had been bullied for a number of years at his school. In February another inquest heard of the painkiller overdose death of 15-year-old Gemma Dimmick, also of Northumberland whose parents claimed she had been bullied at the same school, Hirst High. |
