The E-Accountability Foundation announces the

'A for Accountability' Award

to those who are willing to whistleblow unjust, misleading, or false actions and claims of the politico-educational complex in order to bring about educational reform in favor of children of all races, intellectual ability and economic status. They ask questions that need to be asked, such as "where is the money?" and "Why does it have to be this way?" and they never give up. Manhattan DA Morgenthau Indicts Former NYC DOE Custodian For Theft

Manhattan District Attorney Robert M. Morgenthau announced today the indictment of a 68-year-old former school custodian for stealing $30,000 from a Department of Education bank account.

MILAN O'BRADOVICH, is a former school custodian who worked with the Department of Education ("DOE") for 23 years. His last place of employment was as a contracted employee for Louis D. Brandeis High School in Manhattan (145 West 84th Street) from January 21, 2000 to October 23, 2003. O'BRADOVICH is charged with stealing funds during a two day period while he worked at Brandeis High School.

To pay for custodial services, the DOE established bank accounts in the name of the school custodians at each New York City school; money was wired from the DOE into each of these accounts. All the bank accounts were set up at JPMorgan Chase. Custodians would use that money to pay for school supplies, repairs, building maintenance, and payroll for the custodians' staff. In addition, an amount was allotted to pay the custodians' own salary. The accounts were monitored by the DOE.

The investigation leading to today's arrest revealed that on January 2, 2003, the DOE wired the regular biweekly allocation of $29,400 into the O'BRADOVICH/DOE joint checking account. On January 3, 2003, O'BRADOVICH wrote a check to himself in the amount of $30,000 from the DOE account and deposited that check into a personal account at Commerce Bank. On the same day, the defendant also wrote a check to himself in the amount of $30,000 from his Commerce Bank account and deposited that check into his personal HSBC Bank account.

O'BRADOVICH did not have the authority to make the initial withdrawal of $30,000 nor any bank transfers thereafter with the DOE money. The DOE noticed that the defendant was commingling funds in the JPMorgan Chase account. The investigation was initially referred to the Special Commissioner of Investigation ("SCI"). SCI then referred the case to the Manhattan District Attorney's Office.

MILAN O'BRADOVICH has been charged with Grand Larceny in the 3rd Degree and Criminal Possession of Stolen Property in the 3rd Degree, which are both class D felonies punishable by up to seven years in prison. O'BRADOVICH was arrested today at 80 Centre Street, New York, NY. He will be arraigned tomorrow in New York State Supreme Court.

Assistant District Attorney Adler Bernard is in charge of the prosecution under the supervision of Special Prosecutions Bureau Chief Leroy Frazer.
